Terms & Conditions
Last updated: 20 September 2026
Welcome to Bell & Barter.
These Terms & Conditions govern your access to and use of the Bell & Barter website, the creation and use of an account, and purchases made from Bell & Barter.
Please read them carefully before placing an order.
These Terms are intended to comply with applicable South African law, including, where applicable:
-
the Consumer Protection Act 68 of 2008 (“CPA”);
-
the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”);
-
the Protection of Personal Information Act 4 of 2013 (“POPIA”);
-
the Promotion of Access to Information Act 2 of 2000 (“PAIA”);
-
the applicable Consumer Goods and Services Industry Code;
-
applicable intellectual-property legislation, including the Copyright Act 98 of 1978 and Trade Marks Act 194 of 1993; and
-
other legislation and regulations applicable to the particular transaction.
Nothing in these Terms is intended to exclude, restrict or waive a right or remedy that cannot lawfully be excluded, restricted or waived.
IMPORTANT CONSUMER NOTICE
Certain provisions of these Terms:
-
limit Bell & Barter’s liability;
-
allocate certain risks between Bell & Barter and you;
-
require you to take responsibility for certain actions;
-
regulate the use of third-party services;
-
impose obligations relating to account security and lawful website use; or
-
may require you to indemnify Bell & Barter in limited circumstances arising from your own unlawful conduct.
These provisions are identified in the relevant sections below.
They do not exclude liability for gross negligence or any liability, obligation or consumer right that may not lawfully be excluded under the CPA or other applicable law.
You should read these provisions before placing an order.

Not every category will necessarily be available at all times.
3. Our suppliers and brands
Bell & Barter obtains products from manufacturers, authorised distributors, wholesalers and other legitimate suppliers.
References on our website to trademarks, characters, entertainment franchises, games, manufacturers, distributors or brands do not mean that Bell & Barter owns those intellectual-property rights.
Unless expressly stated otherwise:
-
Bell & Barter is an independent retailer;
-
the relevant trademarks and other intellectual property belong to their respective owners;
-
the sale of a licensed product does not transfer intellectual-property rights in the underlying character, brand, artwork or franchise to the purchaser; and
-
the presence of a brand on our website does not necessarily mean Bell & Barter is that brand’s exclusive distributor, agent or representative.
PART B — THESE TERMS
4. When these Terms apply
These Terms apply when you:
-
browse or use our website;
-
create or use a customer account;
-
submit an order;
-
purchase products from Bell & Barter; or
-
otherwise use services provided through our website.
Product-specific or promotional terms may also apply.
Where additional terms apply, they form part of your agreement with Bell & Barter.
If product-specific terms conflict with these general Terms, the product-specific terms will ordinarily apply to that particular product or promotion, subject always to applicable law.
5. Policies forming part of these Terms
The following Bell & Barter policies should be read together with these Terms:
-
Privacy Policy;
-
Shipping & Delivery Policy;
-
Refunds, Returns & Cancellations Policy;
-
any applicable competition rules;
-
any preorder or special-order terms displayed before purchase; and
-
any other policy expressly incorporated into a transaction.
Nothing in these policies overrides a non-waivable right under South African law.
6. Plain-language interpretation
These Terms should be interpreted in a reasonable manner consistent with their ordinary meaning and applicable consumer law.
Headings are included for convenience.
Words such as “including” or “includes” are not intended to limit the examples that follow.
7. Changes to these Terms
Bell & Barter may update these Terms from time to time to reflect changes in:
-
legislation;
-
our business;
-
our suppliers;
-
our technology;
-
payment methods;
-
delivery arrangements; or
-
our products and services.
Changes will be published with an updated effective date.
A later version will not retrospectively remove rights already acquired under an existing transaction unless the law permits that change and it has been properly agreed.
For a purchase, the terms applicable at the time the relevant transaction was concluded will ordinarily govern that transaction.
PART C — ELIGIBILITY & ACCOUNTS
8. Capacity to contract
You may only conclude a binding purchase if you have the legal capacity to do so.
If you are an unemancipated minor, your purchase must be made with the necessary consent or assistance of your parent or legal guardian where required by law.
Bell & Barter may reasonably refuse or cancel a transaction where we become aware that the person attempting to conclude it does not have the necessary legal capacity, subject to applicable law.
9. Customer accounts
You may be permitted to create an account for features such as:
-
viewing orders;
-
saving addresses;
-
maintaining wishlists;
-
viewing order history; or
-
accessing other customer features.
You must provide accurate information when creating and maintaining an account.
10. Account security
You are responsible for taking reasonable steps to protect:
-
your password;
-
login credentials;
-
one-time passwords;
-
account recovery information; and
-
devices used to access your account.
You should notify Bell & Barter promptly if you reasonably believe your account has been compromised.
Bell & Barter may temporarily suspend account access where reasonably necessary to investigate suspected fraud or unauthorised access.
We will not use account suspension to deprive a customer of an existing statutory right.
11. One person, multiple accounts and abuse
Customers may not create multiple accounts for the primary purpose of:
-
bypassing product quantity limits;
-
repeatedly claiming once-per-customer promotions;
-
circumventing an account suspension imposed for legitimate security reasons;
-
committing fraud; or
-
manipulating a competition or limited-release allocation.
Bell & Barter may consolidate, restrict or suspend accounts where reasonably necessary to address such conduct.
PART D — ORDERING
12. Reviewing your order
Before finally placing an electronic order, you must be given a reasonable opportunity to:
-
review the transaction;
-
identify and correct mistakes; and
-
withdraw from the transaction.
Please check your:
-
products;
-
quantities;
-
variants;
-
sizes;
-
delivery address;
-
contact details;
-
shipping method; and
-
total price
before submitting the order.
13. Order submission
Submitting an order sends Bell & Barter a request to purchase the selected products.
An automated email acknowledging receipt of the order does not necessarily mean that the order has been finally accepted.
Bell & Barter may carry out reasonable checks relating to:
-
payment;
-
availability;
-
fraud;
-
product quantity limits;
-
delivery feasibility; and
-
obvious system or pricing errors
before accepting an order.
14. Acceptance of an order
Unless we expressly state otherwise, an order is accepted when Bell & Barter communicates acceptance or proceeds to fulfil the order in a manner that objectively indicates acceptance.
Once accepted, Bell & Barter will not cancel the order arbitrarily.
Cancellation after acceptance will only occur where permitted by:
-
these Terms;
-
an agreed condition of the transaction; or
-
applicable law.
15. Right to refuse an order before acceptance
Before an order has been accepted, Bell & Barter may decline it for a legitimate reason, including:
-
payment failure;
-
suspected fraud;
-
inability to verify material order information;
-
stock unavailability;
-
an obvious and inadvertent pricing error;
-
use of automated purchasing tools contrary to these Terms;
-
unlawful activity;
-
a breach of a reasonable product quantity restriction;
-
an unsupported delivery destination; or
-
another lawful reason.
Any amount already collected for an order that is lawfully rejected will be refunded as required by law.
PART E — PRODUCTS
16. Product descriptions
Bell & Barter takes reasonable steps to ensure that product information is accurate.
Descriptions may include information supplied by:
-
manufacturers;
-
licensors;
-
publishers;
-
distributors; or
-
wholesalers.
We will not knowingly use a materially misleading trade description.
17. Product images
Product images are intended to represent the item being sold as accurately as reasonably possible.
However:
-
screen settings may affect colour;
-
scale may not be apparent from an image;
-
pre-release images may be manufacturer renders;
-
packaging may be updated by a manufacturer;
-
minor manufacturing differences may occur; and
-
licensed products may undergo minor packaging or labelling changes.
A material substitution will not be made without your agreement where consent is required.
18. Packaging variations
Manufacturers sometimes alter:
-
packaging;
-
logos;
-
promotional labels;
-
outer boxes;
-
included inserts; or
-
minor design elements
without creating a different underlying product.
Such a variation will not necessarily make the product incorrect where the underlying goods remain materially those ordered.
For collector products where a particular packaging variation is expressly advertised as material to the sale, we will take that advertised variation into account.
19. Trading card products
The contents of booster packs, boxes and other randomised trading card products are determined by the manufacturer.
Bell & Barter does not guarantee:
-
a particular card;
-
rarity;
-
pull rate;
-
monetary return;
-
resale value;
-
grading outcome; or
-
investment return.
Random results inherent in the product are not product defects.
This does not affect a claim relating to genuine tampering, missing manufacturer contents, counterfeit goods or another legally recognised defect.
20. Trading card singles
Where Bell & Barter sells individual cards, the description may identify matters such as:
-
edition;
-
set;
-
language;
-
condition;
-
rarity;
-
finish;
-
printing; or
-
other material characteristics.
Condition assessments involve reasonable judgement and recognised collecting conventions where applicable.
Normal differences of opinion within a stated condition grade do not necessarily amount to a defect.
A material discrepancy between the item described and the item supplied will be handled in accordance with applicable law.
21. Collectible values
The market value of:
-
cards;
-
sealed TCG products;
-
limited editions;
-
figures;
-
collectibles; or
-
other products
may rise or fall.
Bell & Barter does not warrant any future resale value or investment performance.
A subsequent change in secondary-market value does not constitute a product defect.
22. Safety warnings and instructions
Customers must comply with safety warnings, manufacturer instructions and age recommendations supplied with products.
Products such as:
-
collectibles with small parts;
-
glassware;
-
prop replicas;
-
display pieces;
-
tools or functional accessories; or
-
products intended primarily for adults
may require special care.
Product warnings and instructions supplied by manufacturers or licensors should not be removed, disregarded or intentionally obscured.
Nothing in this clause limits liability relating to inadequate warnings where the CPA provides otherwise.
23. Parallel imports, reconditioned and specially classified goods
Where Bell & Barter sells goods that are required by law to be identified as:
-
reconditioned;
-
rebuilt;
-
remade;
-
grey-market or parallel-imported; or
-
otherwise specially classified,
the applicable disclosure will be made as required by law.
Product-specific disclosure forms part of the relevant product description.
PART F — STOCK
24. Stock information
Bell & Barter takes reasonable steps to maintain accurate inventory records.
Stock can nevertheless occasionally become unavailable because of:
-
simultaneous orders;
-
stock-count discrepancies;
-
damaged stock;
-
distributor allocations;
-
supplier errors;
-
theft or loss; or
-
other circumstances.
Bell & Barter will comply with the CPA and ECTA where an order cannot be fulfilled.
25. Overselling
Bell & Barter will not knowingly accept payment for goods where we have no reasonable basis to believe they can be supplied.
Where Bell & Barter has made a commitment to supply goods and cannot fulfil that commitment due to insufficient stock, the customer will receive the remedies required by applicable law.
Nothing in these Terms excludes the customer’s rights under section 47 of the CPA.
26. Limited releases and quantity restrictions
Bell & Barter may impose reasonable per-customer or per-household purchase limits on products such as:
-
limited editions;
-
scarce TCG releases;
-
allocated stock;
-
promotional items; or
-
highly constrained new releases.
Any material limit should be disclosed before purchase where reasonably practicable.
Limits will be applied reasonably and not for a prohibited discriminatory purpose.
27. Bulk purchases
The Bell & Barter online store is primarily intended for retail purchases unless otherwise stated.
Orders that appear to be for:
-
commercial resale;
-
wholesale;
-
automated stock acquisition; or
-
unusually large quantities
may be referred for manual review before acceptance.
Wholesale arrangements are subject to separate trade terms.
PART G — PRICES
28. Currency
Unless stated otherwise, prices are displayed in South African Rand (ZAR).
29. Taxes
Prices will include taxes that South African law requires to be included in the displayed consumer price.
If Bell & Barter is registered for VAT, VAT will be dealt with in accordance with applicable tax legislation.
30. Pricing errors
Bell & Barter takes reasonable care to display correct prices.
If a displayed price contains an inadvertent and obvious error, Bell & Barter may correct the error and take reasonable steps to inform affected consumers of:
-
the error; and
-
the correct price,
as contemplated by applicable consumer law.
Bell & Barter will not rely on this provision merely because a correctly advertised price later becomes commercially inconvenient.
If the transaction cannot lawfully proceed at the erroneous price, any affected payment will be dealt with in accordance with applicable law.
31. Multiple displayed prices
Where applicable consumer law requires Bell & Barter to honour the lower of multiple concurrently displayed prices, we will do so.
32. Price changes
Prices may change from time to time.
A future price change does not ordinarily affect a transaction already validly concluded at a previously agreed price.
PART H — PAYMENT
33. Payment methods
Bell & Barter may offer payment methods such as:
-
bank card;
-
instant electronic payment;
-
EFT;
-
payment links;
-
third-party payment services; or
-
other methods displayed at checkout.
Available methods may change.
34. Payment providers
Payments may be processed by independent payment-service providers.
Their own security systems and service terms may apply to the payment-processing service.
The use of a third-party payment provider does not remove Bell & Barter’s obligations to the consumer under applicable law.
35. Payment security
Bell & Barter will use a payment system that is sufficiently secure with reference to accepted technological standards applicable to the transaction.
Card information may be handled directly by the payment processor rather than stored by Bell & Barter.
Our Privacy Policy provides further information on how payment-related and personal information is handled.
36. Payment verification
Bell & Barter may conduct reasonable fraud and payment verification before dispatching an order.
We may request reasonable supporting information where a transaction has been flagged as potentially fraudulent.
Any information collected will be handled in accordance with POPIA and our Privacy Policy.
37. Chargebacks
A customer retains any lawful right to dispute a transaction with a payment provider.
However, deliberately initiating a false or fraudulent chargeback after receiving and retaining correctly supplied goods may constitute fraud or breach of contract.
Bell & Barter may provide relevant transaction, delivery and communication evidence to its payment provider when responding to a chargeback.
This clause does not prejudice a genuine billing or consumer dispute.
PART I — PREORDERS & SPECIAL ORDERS
38. Preorders
A preorder reserves or requests stock expected to become available at a future date.
Release and availability dates may be based on information received from:
-
publishers;
-
manufacturers;
-
licensors;
-
distributors; or
-
freight providers.
Those dates may change.
Bell & Barter does not control a manufacturer’s global release schedule or a distributor’s allocation of stock.
We will, however, comply with applicable law relating to fulfilment and cancellation.
39. Preorder allocations
A supplier may occasionally reduce an allocation after retailers have accepted preorders.
Bell & Barter will not knowingly sell preorder quantities where we have no reasonable basis to expect supply.
If an upstream allocation is reduced unexpectedly, we will take reasonable steps to notify affected customers promptly and apply any remedy required by law.
40. Special orders
A product specially sourced, created, altered, personalised or procured specifically for a customer’s requirements may constitute a special-order product.
Additional cancellation conditions may apply to genuine special-order goods.
Those conditions will be disclosed before purchase where required.
Defective or incorrectly supplied special-order products remain subject to applicable statutory rights.
PART J — DELIVERY
41. Shipping Policy
Delivery is governed by our Shipping & Delivery Policy, which forms part of these Terms.
Among other things, it explains:
-
processing times;
-
courier selection;
-
estimated delivery times;
-
address requirements;
-
delivery attempts;
-
lost parcels;
-
damaged parcels;
-
preorder shipments; and
-
events outside our reasonable control.
42. Risk in goods
Where the CPA applies, goods remain at Bell & Barter’s risk until they have been accepted by the customer or an authorised recipient as contemplated by applicable law.
We do not rely on a clause stating that all risk automatically passes merely because the parcel has been handed to our courier.
43. Ownership
Ownership of goods may remain with Bell & Barter until payment for those goods has been made in full, to the extent permitted by law.
This does not alter statutory rules concerning risk in goods during delivery.
PART K — CANCELLATIONS, RETURNS & REFUNDS
44. Returns Policy
Returns, refunds and cancellations are governed by our Refunds, Returns & Cancellations Policy.
That Policy covers, among other things:
-
ECTA cooling-off rights;
-
CPA direct-marketing cancellations;
-
defective goods;
-
incorrect products;
-
change-of-mind returns;
-
sealed TCG products;
-
randomised products;
-
apparel;
-
books;
-
preorders;
-
special orders;
-
sale items;
-
courier damage;
-
inspection;
-
return shipping; and
-
refunds.
45. Statutory rights take precedence
If these Terms, our Returns Policy or a supplier warranty conflict with a non-waivable consumer right, the applicable law prevails.
PART L — WARRANTIES & PRODUCT ISSUES
46. CPA implied warranty
Where sections 55 and 56 of the CPA apply, goods carry the statutory implied warranty of quality.
Bell & Barter’s Returns Policy explains how qualifying defective-goods claims are handled.
47. Manufacturer and distributor warranties
Some products carry additional warranties provided by:
-
the manufacturer;
-
importer;
-
licensor;
-
distributor; or
-
another upstream supplier.
These may provide rights in addition to statutory rights.
Bell & Barter may assist with or facilitate such claims.
An upstream supplier’s refusal of Bell & Barter’s own wholesale warranty claim does not extinguish a customer’s statutory remedy against Bell & Barter where such remedy exists.
48. Warranty conditions
A manufacturer’s additional warranty may contain lawful conditions relating to matters such as:
-
proper use;
-
storage;
-
maintenance;
-
serial numbers;
-
tampering;
-
modifications; or
-
proof of purchase.
Those conditions apply to the additional manufacturer warranty to the extent lawful.
They do not override the CPA.
PART M — PRODUCT RECALLS
49. Recalls and safety notices
If Bell & Barter becomes aware of a legitimate product recall or material safety notice affecting goods we have sold, we may:
-
contact affected customers;
-
publish a notice;
-
suspend sales;
-
arrange a return;
-
provide manufacturer instructions; or
-
take another reasonable measure.
Customers should follow legitimate recall instructions promptly.
50. Sharing information for a recall
Where reasonably necessary and legally permitted, Bell & Barter may share limited transaction information with a:
-
manufacturer;
-
distributor;
-
regulator;
-
courier;
-
insurer; or
-
authorised recall administrator
for purposes of a legitimate safety investigation or recall.
Any processing will remain subject to applicable data-protection law.
PART N — GIFT CARDS, STORE CREDIT & PROMOTIONS
51. Paid gift cards and vouchers
If Bell & Barter sells prepaid gift cards or vouchers, their expiry and redemption will comply with section 63 of the CPA.
A paid voucher will not expire earlier than permitted by law.
52. Promotional vouchers
A promotional code or voucher supplied without the customer paying value specifically for that voucher may be subject to separate promotional conditions, including:
-
start and end dates;
-
participating products;
-
minimum spend;
-
once-per-customer restrictions; or
-
exclusions.
Such conditions will be disclosed with the promotion and will remain subject to applicable law.
53. Store credit
Store credit may arise from:
-
a voluntary goodwill arrangement;
-
promotion;
-
return;
-
cancellation; or
-
other adjustment.
Where a customer has a statutory right to a monetary refund, Bell & Barter will not compel the customer to accept store credit instead.
54. Discount codes
Unless stated otherwise:
-
only one promotional code may be used per order;
-
codes may apply only to participating products;
-
codes cannot ordinarily be exchanged for cash;
-
codes may not be reproduced or manipulated fraudulently; and
-
a promotion may end on its stated closing date or once legitimately allocated stock is exhausted.
PART O — PROMOTIONAL COMPETITIONS
55. Competitions
Bell & Barter may occasionally conduct promotional competitions.
Each competition will be subject to separate competition rules prepared and made available in accordance with applicable law.
Those rules may specify:
-
eligibility;
-
entry method;
-
closing date;
-
prize;
-
winner-selection method;
-
announcement method;
-
collection or delivery arrangements; and
-
other lawful terms.
Where there is a conflict, the competition-specific rules will apply to the competition.
56. Competition integrity
Bell & Barter may disqualify an entry where there is reasonable evidence of:
-
fraud;
-
automated manipulation;
-
multiple prohibited entries;
-
false information;
-
interference with the competition; or
-
another material violation of the published competition rules.
Any decision will be exercised reasonably and in accordance with applicable law.
PART P — INTELLECTUAL PROPERTY
57. Bell & Barter intellectual property
The Bell & Barter name, logos, merchant marks, website design, original photographs, original copy, illustrations and other proprietary materials may be protected by:
-
copyright;
-
trade mark rights;
-
design rights;
-
common-law rights; or
-
other intellectual-property protections.
Nothing on the website transfers ownership of those rights to a user.
58. Supplier, manufacturer and licensor intellectual property
Product images, artwork, logos, names, character designs and descriptions may belong to or be licensed by:
-
manufacturers;
-
publishers;
-
studios;
-
game companies;
-
distributors;
-
licensors; or
-
other rights-holders.
Those rights remain the property of their respective owners.
Bell & Barter’s lawful use of such material for retail purposes does not give a website visitor permission to copy or commercially exploit it.
59. Permitted website use
You may use the website for ordinary personal shopping and informational purposes.
You may not, without lawful authority:
-
copy substantial parts of the website;
-
reproduce our original product photography commercially;
-
reproduce Bell & Barter branding;
-
falsely represent yourself as Bell & Barter;
-
use our content to create counterfeit products;
-
remove copyright or trade mark notices;
-
create a misleadingly similar website;
-
scrape proprietary content at unreasonable scale; or
-
otherwise infringe Bell & Barter’s or a third party’s intellectual-property rights.
60. Genuine products and counterfeiting
Bell & Barter supports the legitimate sale of genuine products.
Users may not use Bell & Barter’s website, customer services, communities or other facilities to:
-
market counterfeit goods;
-
substitute counterfeit goods in a return;
-
falsify authenticity information;
-
alter serial numbers;
-
reproduce authentication labels;
-
misrepresent a counterfeit item as having been supplied by Bell & Barter; or
-
otherwise interfere with product authenticity controls.
Bell & Barter may preserve and disclose relevant evidence where reasonably necessary to investigate suspected criminal or fraudulent activity and where permitted by law.
PART Q — WEBSITE USE
61. Lawful use
You may not use the Bell & Barter website to:
-
commit fraud;
-
obtain unauthorised access;
-
transmit malicious software;
-
interfere with website operation;
-
scrape or overload the service abusively;
-
bypass security measures;
-
impersonate another person;
-
manipulate product availability;
-
commit a cybercrime;
-
infringe intellectual-property rights; or
-
engage in unlawful conduct.
62. Bots and automated purchasing
Bell & Barter may implement reasonable technical measures to protect limited stock against abusive automated purchasing.
You may not use software designed primarily to:
-
bypass product limits;
-
defeat checkout security;
-
monopolise limited releases;
-
create large numbers of false accounts; or
-
interfere with fair access to products.
Bell & Barter may block such activity and, where legally permissible, reject affected transactions.
63. Website availability
We take reasonable steps to maintain the website.
The website may occasionally be unavailable because of:
-
maintenance;
-
hosting faults;
-
telecommunications failures;
-
cybersecurity incidents;
-
third-party platform failures;
-
updates; or
-
circumstances outside our reasonable control.
Bell & Barter does not guarantee uninterrupted access at every moment.
This does not exclude liability arising from gross negligence or another liability that cannot lawfully be excluded.
64. External links
Our website may contain links to third-party websites or services.
A link does not necessarily mean Bell & Barter:
-
owns that website;
-
controls it;
-
guarantees its availability; or
-
endorses every statement made on it.
Customers should review the third party’s own terms and privacy practices where appropriate.
PART R — REVIEWS & CUSTOMER CONTENT
65. Reviews
Customers may be permitted to submit:
-
reviews;
-
photographs;
-
comments;
-
questions; or
-
other content.
You remain responsible for content you submit.
66. Prohibited customer content
You may not knowingly submit content that:
-
is unlawful;
-
is fraudulent;
-
infringes another person’s intellectual property;
-
unlawfully discloses personal information;
-
contains malicious code;
-
falsely impersonates another person; or
-
contains material that Bell & Barter is legally required to remove.
Bell & Barter may moderate or remove such content where reasonably necessary.
We will not remove genuine negative reviews merely because they are critical of us.
67. Licence to display submitted content
Where you voluntarily submit a review or image for publication, you grant Bell & Barter a non-exclusive, royalty-free licence to host, reproduce and display that content for purposes reasonably connected with:
-
displaying the review;
-
promoting the product to which the review relates; or
-
operating Bell & Barter’s business,
unless otherwise agreed.
You retain ownership of intellectual-property rights you lawfully hold in the content.
PART S — PRIVACY & COMMUNICATIONS
68. Personal information
Bell & Barter processes personal information in accordance with its Privacy Policy and applicable law, including POPIA.
Please read the Privacy Policy for information about:
-
what information we collect;
-
why we collect it;
-
legal grounds for processing;
-
payment providers;
-
couriers;
-
suppliers;
-
cookies;
-
security;
-
retention;
-
data-subject rights; and
-
cross-border processing.
69. Transactional communications
By placing an order, you acknowledge that Bell & Barter may send communications reasonably necessary to:
-
confirm the order;
-
process payment;
-
provide tracking;
-
communicate delays;
-
handle returns;
-
address fraud or security;
-
provide recall information; or
-
administer the transaction.
These are transactional communications and are distinct from optional marketing.
70. Marketing
Electronic direct marketing will be conducted in accordance with applicable law, including POPIA.
Where consent is legally required, Bell & Barter will seek it.
Customers will be provided with the applicable mechanism to object to or unsubscribe from electronic direct marketing.
Opting out of promotional marketing does not prevent Bell & Barter from sending communications necessary to administer an existing transaction.
71. PAIA requests
Requests for access to records will be handled in accordance with PAIA, POPIA and Bell & Barter’s applicable PAIA procedures or manual.
PART T — SUPPLIERS & THIRD PARTIES
72. Bell & Barter is the retailer
Where you buy directly from Bell & Barter, your retail sale is with Bell & Barter unless we clearly state otherwise before the transaction.
Our manufacturers, licensors, distributors and wholesalers do not become the retail contracting party merely because they supplied the product to Bell & Barter.
73. Supplier commercial agreements
Bell & Barter may itself be subject to agreements with upstream suppliers relating to:
-
territory;
-
intellectual property;
-
warranties;
-
marketing materials;
-
product handling;
-
product launches;
-
recalls;
-
reporting;
-
distribution;
-
authorised channels; or
-
other commercial matters.
These upstream agreements regulate Bell & Barter’s relationship with those suppliers.
They do not automatically remove or reduce consumer rights under South African law.
74. Protection of suppliers and licensors
Customers must not use Bell & Barter’s services to:
-
impersonate one of our suppliers;
-
falsely claim to be an authorised distributor;
-
infringe supplier trademarks or copyrights;
-
reproduce licensed artwork unlawfully;
-
defeat product authentication measures;
-
distribute counterfeit products;
-
manipulate warranty claims;
-
falsify serial numbers; or
-
submit fraudulent returns.
Bell & Barter may take reasonable measures to protect its own rights and the legitimate rights of manufacturers, licensors and suppliers.
75. Supplier information
Bell & Barter may rely on product specifications and other factual information supplied by reputable manufacturers or distributors.
We will take reasonable steps to correct material information that we discover is inaccurate.
A supplier-originated error does not entitle Bell & Barter to knowingly continue making a misleading representation after becoming aware of it.
PART U — MARKETPLACES, CLAIM SALES & OTHER SALES FORMATS
76. Additional sales formats
Bell & Barter may in future provide or facilitate:
-
claim sales;
-
consignment sales;
-
marketplace transactions;
-
auctions;
-
live sales;
-
trade-ins; or
-
other sales formats.
These may involve different legal relationships and therefore may be subject to separate terms.
77. Auctions
An ordinary fixed-price online sale is not an auction merely because stock is limited or customers compete to purchase it.
Where Bell & Barter conducts a formal auction, the transaction will be governed by the applicable auction rules, section 45 of the CPA and applicable regulations.
Auction-specific rules will be supplied separately.
PART V — FRAUD & RETURN ABUSE
78. Fraud prevention
Bell & Barter may take reasonable measures to detect and prevent:
-
payment fraud;
-
account takeover;
-
stolen cards;
-
return substitution;
-
counterfeit returns;
-
false non-delivery claims;
-
promotion abuse; and
-
other fraudulent activity.
79. Return verification
A returned product may be inspected to verify:
-
identity;
-
serial number;
-
authenticity;
-
completeness;
-
condition; and
-
alleged defect.
Inspection will not be used as an excuse to unlawfully withhold a remedy.
80. Fraudulent claims
Where reasonable evidence establishes that a claim is fraudulent, Bell & Barter may:
-
refuse the fraudulent claim;
-
suspend affected accounts;
-
dispute a chargeback;
-
preserve relevant evidence;
-
report suspected criminal conduct; or
-
exercise another lawful remedy.
A legitimate consumer complaint will not be treated as fraud simply because Bell & Barter disagrees with it.
PART W — IMPORTANT LIABILITY PROVISIONS
81. IMPORTANT NOTICE: statutory rights remain protected
PLEASE READ THIS PART CAREFULLY. IT CONTAINS TERMS THAT LIMIT LIABILITY AND ALLOCATE RISK.
Nothing in these Terms:
-
excludes liability for Bell & Barter’s gross negligence;
-
excludes statutory product liability where it applies;
-
excludes liability that cannot lawfully be excluded;
-
deprives a consumer of a right under the CPA or ECTA; or
-
requires a consumer to assume an unfair or unlawful risk.
82. Matters reasonably outside Bell & Barter’s control
To the extent permitted by law, Bell & Barter will not be liable for losses caused solely by circumstances genuinely outside our reasonable control where we have acted reasonably.
Examples may include:
-
major courier-network interruption;
-
national telecommunications outages;
-
manufacturer release delays;
-
supplier allocations;
-
customs delays;
-
natural disasters;
-
severe weather;
-
civil unrest;
-
widespread power failures;
-
cyberattacks despite reasonable security measures;
-
governmental restrictions; or
-
similar events.
This does not remove any cancellation, delivery, refund or other remedy that applicable law gives the customer despite such an event.
83. Indirect losses
To the extent permitted by law, Bell & Barter will not be responsible for indirect or consequential losses that:
-
were not reasonably foreseeable when the contract was concluded; and
-
do not arise from liability that cannot lawfully be excluded.
For example, an ordinary estimated courier delay does not make Bell & Barter responsible for an unrelated speculative resale opportunity lost because a collectible’s market price later changed.
84. Secondary-market losses
Bell & Barter sells collectibles as consumer products, not as guaranteed investments.
To the extent permitted by law, Bell & Barter is not responsible for losses arising solely from:
-
a card decreasing in value;
-
a collectible becoming less scarce;
-
a reprint;
-
a new product release;
-
grading outcomes;
-
market speculation; or
-
another secondary-market fluctuation.
85. Third-party services
Where an independent third party provides a separate service—such as:
-
courier tracking;
-
card payment processing;
-
finance;
-
external authentication;
-
grading;
-
social-media functionality; or
-
another third-party platform—
Bell & Barter does not control every aspect of that independent service.
This clause does not remove Bell & Barter’s own obligations to the consumer.
86. Customer-caused loss
Bell & Barter will not ordinarily be responsible for loss caused solely by the customer’s own:
-
misuse;
-
unauthorised modification;
-
failure to follow clear safety instructions;
-
negligent storage;
-
deliberate damage;
-
unlawful conduct; or
-
disclosure of account credentials,
where Bell & Barter did not legally cause or contribute to the loss.
PART X — LIMITED INDEMNITY
87. IMPORTANT NOTICE: unlawful misuse
TO THE EXTENT PERMITTED BY LAW, you are responsible for reasonable losses suffered by Bell & Barter as a direct result of your deliberate unlawful use of the website, fraud, or infringement of intellectual-property rights.
This may include a claim arising directly from your:
-
intentionally submitting counterfeit goods as a return;
-
unlawfully copying Bell & Barter proprietary materials for commercial exploitation;
-
deliberately compromising our systems; or
-
knowingly impersonating Bell & Barter.
This indemnity does not:
-
apply to Bell & Barter’s own gross negligence;
-
require you to indemnify Bell & Barter for a statutory liability that cannot lawfully be transferred;
-
apply merely because you exercise a legitimate consumer right; or
-
create an unfair or unreasonable obligation prohibited by the CPA.
PART Y — SECURITY
88. Cybersecurity
Bell & Barter takes reasonable technical and organisational measures appropriate to its operations.
No internet-connected system can truthfully be guaranteed to be immune from every possible attack.
Customers should also take reasonable precautions such as:
-
using unique passwords;
-
protecting one-time PINs;
-
ignoring suspicious messages; and
-
verifying payment requests.
Bell & Barter will never rely on this clause to excuse a failure to comply with a legal security obligation.
89. Suspicious communications
Customers should verify any unusual request purporting to come from Bell & Barter, particularly a request to:
-
pay into a different bank account;
-
provide passwords;
-
disclose an OTP;
-
install software; or
-
provide unnecessary financial information.
Please contact us through our official website details if uncertain.
PART Z — TERMINATION & SUSPENSION
90. Website access
Bell & Barter may restrict or suspend a user’s access where reasonably necessary because of:
-
fraud;
-
cybersecurity threats;
-
unlawful behaviour;
-
serious abuse;
-
repeated deliberate violation of these Terms; or
-
technical security requirements.
91. Existing transactions
Suspending a customer account does not automatically cancel an existing order or remove existing consumer rights.
Any affected transaction will be dealt with according to its own status and applicable law.
PART AA — DISPUTES & COMPLAINTS
92. Contact Bell & Barter first
If you are dissatisfied with a transaction, please contact us so that we can investigate the issue.
Please provide the information reasonably necessary to locate the order and understand the complaint.
93. Consumer Goods and Services Ombud
Bell & Barter operates within the consumer goods and services sector and is subject to applicable obligations under the Consumer Goods and Services Industry Code.
